Where to find information concerning the legality of cash gifting [is cash gifting legal?] by Rex Harris Sep 23

Recently, I was approached with questions of the legality of several online [home business opportunities and program] to include gifting.  Most of what I have heard, over the years, points to a place where most people just don’t know whether cash gifting is legal or not.I took it upon myself to do the research concerning the legality of cash gifting, in the United States, and here is what I found.First, I went to Google and conducted a search by asking the question “is cash gifting legal?”  Here’s what I found on the website of The Federal Trade Commission:

In reality, the clubs are illegal pyramid schemes. New club members give cash “gifts” to the highest-ranking club members, with titles such as “captains.” And they’re promised that if they get additional members to join the club, they, too, will rise to become captains and receive money – far more than they initially paid to join the club — from newer club “friends.”

Second… after finding this information, I placed a phone call to the Federal Trade Commission where I was told…

Cash gifting, in the United States, is legal, based on an IRS tax code that allows anyone to give anyone a one time gift up the amount of $11,000.  (I have now heard that the limit is $12,500 so do your homework.)

However, as the conversation went on, it became more interesting when I was told, as stated on the website that…

Gifting clubs/programs are not legal.  However, in order for any action to be taken concerning the subject of “gifting clubs”, there would need to be a large volume of complaints filed to the FTC or government authorities before any legal action would ever be taken.
